By using ChargeVia charging stations, website, or services ("Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use our Services.

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Services. By using our Services, you represent that you meet these requirements.

Account Registration

To access certain features, you may need to create a Pathfinder Rewards account. You are responsible for:

  • Providing accurate and complete information
  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use

Charging Services

Use of Charging Stations

When using ChargeVia charging stations, you agree to:

  • Follow all posted instructions and safety guidelines
  • Only charge compatible electric vehicles
  • Not damage, tamper with, or vandalize equipment
  • Move your vehicle promptly after charging completes
  • Pay all applicable fees for charging sessions

Pricing and Payment

Charging fees are displayed at the station before you start a session. Prices may vary by location. By initiating a charging session, you authorize us to charge your selected payment method. All sales are final.

Service Availability

We strive to maintain high uptime but cannot guarantee that charging stations will always be available or operational. We are not liable for any damages resulting from charger unavailability.

Pathfinder Rewards Program

Participation in the Pathfinder Rewards program is subject to these Terms and any additional program rules. We reserve the right to modify, suspend, or terminate the program at any time. Credits have no cash value and may not be transferred or sold.

User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Interfere with or disrupt our Services
  • Attempt to gain unauthorized access to our systems
  • Use our Services for any illegal or unauthorized purpose
  • Harass, abuse, or harm other users or our staff

Intellectual Property

All content, trademarks, and intellectual property related to ChargeVia are owned by us or our licensors. You may not use our trademarks or copyrighted material without our prior written consent.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARGEVIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

Indemnification

You agree to indemnify and hold harmless ChargeVia and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of our Services after changes take effect constitutes acceptance of the new Terms.

Termination

We may suspend or terminate your access to our Services at any time for any reason, including violation of these Terms. Upon termination, your right to use our Services ceases immediately.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of our Services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class actions.
